Dutch regulator fines Unibet €4 million for failing to protect players

Unibet, operated by Optdeck Service Limited, has been fined €4 million by the Netherlands Gambling Authority (KSA) for failing to meet requirements related to player protection.

The fine follows an investigation into Unibet’s compliance between July 2022 and July 2024, focusing on how the company responded to signs of excessive gambling among users.

Investigation findings

The KSA reviewed several player records from Optdeck and determined that none adequately complied with the duty of care.

In cases where players deposited thousands of euros daily, Unibet did not intervene in a timely manner. It often took several weeks before the company requested information about users’ income, by which point substantial losses had already occurred.

Unibet also used interventions deemed ineffective by the regulator, including simple pop-up notifications that could be dismissed easily. An additional concern was that the company counted income sources not permitted under KSA rules, such as business account funds, when checking a player’s financial situation.

Regulatory response

Michel Groothuizen, Chair of the KSA board, emphasised the seriousness of the breaches.

“When there are signs of excessive gambling and a person wagers a large amount in a short time, a provider must promptly look into the origin of the money. Income details should be requested, and providers must analyse this information properly, as not all financial resources may be counted. The Ksa takes violations of this duty of care very seriously and will continue strict enforcement,” said Groothuizen.

The KSA stated that operators have a legal responsibility to protect players from gambling addiction and irresponsible behaviour. It warned that lenient or delayed actions are not acceptable practices.

Player protection challenges

The regulator highlighted that effective measures must be in place for timely identification and intervention when risky gambling patterns are detected. The investigation found that Unibet’s responses did not align with recognised best practices for managing responsible gambling and risk controls.

According to the official statement, reviewing income sources thoroughly and excluding business funds forms a basic part of this process.

Implications for operators

This enforcement action underlines increasing regulatory scrutiny within the Dutch gaming market. Operators must update compliance practices to ensure rapid and adequate risk assessments when customers demonstrate harmful gambling behaviour.

The KSA’s decision signals to the industry that failures to protect consumers will result in substantial penalties. The ruling is expected to encourage further improvements in compliance procedures across the Dutch gaming sector.
