Isle of Man consults on personal fines for operator key staff

The Isle of Man Gambling Supervision Commission (GSC) has completed its consultation on the proposed Gambling Legislation (Amendment) Bill 2025, which aims to extend personal liability for senior staff at licensed operators.
What is proposed
The reforms would hold compliance officers, directors, and senior executives personally liable for breaches of anti-money laundering (AML) and know-your-customer (KYC) obligations.
Civil penalties could apply to individuals where failures occur through “consent, connivance, or simple negligence,” complementing existing penalties for operators.
The GSC has published guidance on how it will assess individual responsibility and calculate personal fines. The consultation closed in August 2025, and in October 2025, the GSC released a response document analyzing 15 submissions from industry participants.
Elevated risk rating
Alongside the legislative reforms, the GSC updated its National Risk Assessment for the gambling sector. The online gambling and overall sector is now rated medium high, while land-based operations remain medium low. This elevation reflects ongoing concerns about Southeast Asian criminal networks and broader international challenges.
Officials noted that systemic compliance gaps, rather than isolated errors, informed this reassessment.
A recent enforcement action against Shelgeyr Limited, which incurred a £200,000 fine for AML and KYC failures, highlighted structural weaknesses in operator compliance frameworks.

The move aligns with European regulatory trends emphasizing personal accountability for compliance breaches, rather than focusing solely on corporate entities.
For operators licensed in the Isle of Man, a longstanding offshore gambling jurisdiction, the changes mark a significant increase in personal liability for senior management.
The GSC is advancing reforms based on industry feedback, preparing for the upcoming MONEYVAL review in Autumn 2026, which will assess the island’s adherence to international AML and counter-terrorist financing standards.
